The last mile of the M&O Sub ( mile point 82.5 - 83.5), which includes the Wye connection between the Alexandria Sub and the M&O Sub, is jointly owned by CN and CP.

VIA owns the rail infrastructure on that last mile of the M&O Sub. Furthermore, under the same transaction, CN & CP granted VIA a perpetual easement to keep the rail infrastructure on CN&CP property for VIA's use in providing passenger services.
In other words, VIA own the tracks, but not the land, however VIA has the right to keep it on their land for use in providing passenger services.
